Agreement to Terms
By engaging In Tyme Web Designs ("we," "our," or "us") for web design services, you ("Client") agree to be bound by these Terms of Service. Please read them carefully before proceeding with any project.
Services Provided
We provide custom web design and development services, including but not limited to:
- Custom-coded websites (HTML, CSS, JavaScript)
- Website migrations from platforms like Wix, Squarespace, or WordPress
- Search engine optimization (SEO)
- Google Business Profile setup and integration
- Professional website photography (Premium package)
- AI chatbot integration
- Ongoing hosting and support services
Payment Terms
All projects require the following payment structure:
- Deposit: 50% of the total project cost is due before work begins. No work will commence until the deposit is received.
- Final Payment: The remaining 50% is due before the website goes live. The website will not be launched until final payment is received.
- Payment Methods: We accept payments via Stripe (credit/debit cards).
- Late Payments: Invoices not paid within 14 days of the due date may result in project delays or suspension of services.
Project Timeline
Typical project timelines are 2-4 weeks from deposit to launch, depending on the package selected and client responsiveness. Timelines may be extended if:
- Client delays in providing required materials (content, images, logos, feedback)
- Scope changes or additional revision requests beyond the included allowance
- Unforeseen technical complications
We will communicate any timeline changes promptly and work with you to minimize delays.
Client Responsibilities
To ensure a smooth project, the Client agrees to:
- Provide all necessary content, images, logos, and branding materials in a timely manner
- Respond to requests for feedback and approvals within 5 business days
- Provide accurate and complete information about their business
- Secure and pay for their own domain name (we can assist with setup)
- Review and approve the website before launch
Revisions
Each package includes a reasonable number of revisions during the build phase. Revisions include changes to layout, colors, fonts, images, and content placement. The following are not considered revisions:
- Bug fixes or technical corrections
- Minor text edits (typos, small wording changes)
Significant scope changes or requests beyond the original project brief may incur additional charges, which will be communicated and agreed upon before proceeding.
Intellectual Property & Ownership
Upon receipt of final payment:
- Client Ownership: The Client owns 100% of the custom code, design, and content created specifically for their project.
- No Lock-In: You are free to take your website to any hosting provider or developer at any time.
- Portfolio Rights: We reserve the right to display the completed work in our portfolio and marketing materials unless otherwise agreed in writing.
- Third-Party Assets: Stock images, fonts, or other licensed assets used in the project are subject to their respective license terms.
Hosting & Support Plans
After the initial hosting period included with your package (60-90 days), ongoing hosting and support are available:
- Hosting Only ($25/month or $250/year): Includes hosting, maintenance, SSL certificate, security monitoring, backups, monthly analytics report, and chatbot maintenance (if applicable).
- Support Plan ($100/month or $1,000/year): Includes everything in Hosting plus up to 3 edits per month (page updates, new photos, new events, new products, content removal, minor tweaks).
Clients may cancel hosting or support plans at any time with 30 days written notice. No refunds will be issued for partial months or unused portions of annual plans.
Website Edits (Without Support Plan)
Clients without an active Support Plan may request website edits at a rate of $50 per hour, billed in 30-minute increments. Estimates will be provided before work begins for larger requests.
Cancellation & Refunds
- Before Work Begins: If the Client cancels before any work has begun, the deposit will be refunded minus a $250 administrative fee.
- After Work Begins: If the Client cancels after work has begun, the deposit is non-refundable as it covers work already completed.
- Completed Projects: No refunds are issued after the website has been launched and final payment has been made.
- Mutual Termination: Either party may terminate the agreement if the other party breaches these terms. In such cases, payment for work completed to date is due.
Limitation of Liability
In Tyme Web Designs shall not be liable for:
- Any indirect, incidental, or consequential damages arising from the use or inability to use the website
- Loss of data, revenue, or business opportunities
- Third-party service outages (hosting providers, domain registrars, payment processors)
- Content provided by the Client that infringes on third-party rights
Our total liability for any claim arising from our services shall not exceed the total amount paid by the Client for the specific project in question.
Indemnification
The Client agrees to indemnify and hold harmless In Tyme Web Designs from any claims, damages, or expenses (including legal fees) arising from:
- Content, images, or materials provided by the Client
- The Client's use of the website
- Any breach of these Terms by the Client
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the project. This includes business strategies, customer data, login credentials, and any information marked as confidential.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from these terms shall be resolved in the courts of Riverside County, California.
Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued engagement of our services after changes constitutes acceptance of the new terms.
